Makers Of 'Joustin' Beaver' Sue Justin Bieber

OH SNAP!  Looks like Beaver vs. Bieber is officially ON! Two weeks after the Biebs filed a 'cease and desist' order against app developer RC3, for their recently released app, Joustin' Beaver hehe, RC3 has turned the tables on Beaver, I mean Bieber, and is now suing him! They claim that they have  the right to distribute the game and are seeking a declaration of non-infringement. Considering that parody is protected by the 1st amendment, looks like Bieber's going down! Ewww.

So what's the game all about?  Our hero Joustin' Beaver navigates the river of stardom, while appeasing fans with 'otter-graphs' and taking out 'phot-hogs' with his lance. I mean the powerful lance alone clearly indicates to me that this is not a direct representation of Bieber...am I right?

The 'cease and desist' order, threatened legal action against RC3  claiming “direct and blatant infringement” of Bieber’s “name, image, likeness, life story or identity.”  So basically they are saying Bieber looks like a beaver. I guess they have a point there. I mean he's at least reminiscent of a beaver.

But  RC3 has made an even better point!! “Nowhere in the game is Justin Bieber’s name, photo, image, or life story mentioned. We were surprised to learn that in addition to being a talented musician, Mr. Bieber is also a fictional beaver.”  Assuming the part about 'talented musician' was said with an eyeroll,  I agree with this statement completely.
